Instead, individuals can self-petition, showcasing their exceptional talents and contributions to their field

EB2 NIW: National Interest Waiver for those whose work benefits the United States.

The EB2 National Interest Waiver (NIW) is a category within the U.S. employment-based immigrant visa program that allows individuals with advanced degrees or exceptional abilities to seek a waiver of the usual job offer and labor certification requirements. To qualify for the NIW, applicants must demonstrate that their work is in the national interest of the United States. This typically involves showcasing their significant contributions and impact in fields such as sciences, arts, education, business, or athletics. This category is particularly advantageous for STEM (Science, Technology, Engineering, and Mathematics) workers since STEM professionals often engage in research, innovation, and contributions that have a direct impact on the national interest of the United States. The EB2 NIW streamlines the immigration process for STEM workers by allowing them to seek a waiver of the traditional job offer and labor certification requirements.

E2: Investor Visa for entrepreneurs making an investment in a new or existing U.S. business.

The E2 Investor Visa is a non-immigrant visa category in the United States, specifically designed for foreign nationals who wish to invest a substantial amount of capital in a U.S. enterprise. To qualify for the E2 visa, applicants must be citizens of a country that has a treaty of commerce and navigation or a bilateral investment treaty with the U.S. The invested capital must be considered at risk and committed to a bona fide enterprise, and the investment must be able to generate job opportunities for U.S. workers. E2 visa holders can reside in the U.S. to oversee and develop their investment, and the visa is typically granted for an initial period of two years, with the option for renewals as long as the qualifying conditions are maintained.

E3: Specialty Occupation Visa for Australian professionals.

The E3 visa is a non-immigrant visa category in the United States, designed specifically for Australian professionals. It allows Australian citizens with specialized skills and a job offer in the U.S. to work temporarily. The E3 visa is similar to the H-1B visa but is exclusively reserved for Australians. To qualify, applicants must have a legitimate job offer, possess the necessary qualifications or skills for the position, and the position itself must meet the visa criteria. The E3 visa is initially granted for up to two years, with the possibility of extensions. Spouses of E3 visa holders are also eligible for work authorization in the U.S.

TN: Trade NAFTA for Canadian and Mexican professionals in certain occupations.

The TN visa is a non-immigrant visa category available to citizens of Canada and Mexico under the North American Free Trade Agreement (NAFTA). It allows professionals in certain occupations to work temporarily in the United States. To qualify for a TN visa, applicants must have a job offer from a U.S. employer in a profession listed in the NAFTA agreement, and they must meet the specific educational and/or experience requirements for that profession. Unlike other visa categories, the TN visa application process is relatively streamlined, often allowing for immediate entry into the U.S. with proper documentation. Initially granted for up to three years, TN visas can be renewed indefinitely in three-year increments.

O1: Extraordinary Ability Visa for individuals with extraordinary skills in arts, sciences, education, business, or athletics.

The O1 visa is a non-immigrant visa in the United States designed for individuals with extraordinary abilities or achievements in the fields of arts, sciences, education, business, or athletics. It is intended for those who have demonstrated a high level of expertise and sustained national or international acclaim in their respective fields. To qualify for an O1 visa, applicants must provide evidence of their extraordinary abilities, such as awards, recognition, or significant contributions to their industry.
